Warranty Statement

Plastic Forests Pty Ltd warrants that products supplied by it to you are free of any manufacturing or raw material defect that will significantly affect the use of the product for the warranty period specified below, providing it has, at all times, only been utilised for its intended purpose, under normal use conditions and is installed in accordance with our product installation guides.

The relevant Warranty Period is as listed for each product in the table below.

The benefits given by this Warranty are in addition to all consumer guarantees and other rights and remedies prescribed by Australian Consumer Law and any other applicable law.

Who can claim under this warranty?

The original purchaser or successor in title, on the provision of proof of purchase in the form of an invoice and receipt, is entitled to claim under this warranty. Without this original proof of purchase, we reserve the right to reject any claim under this warranty.

Our Commitment to You

Plastic Forests is committed to producing the best product possible whilst ensuring the use of recycled plastic as a raw material (instead of using virgin plastic.) As our products are made from 100% recycled plastics (plus processing additives) which are highly variable and add significant complexity to the manufacturing process, some variability in colour, dimensions (due to different shrinkage rates, estimated to be up to 2%), porosity and minor flaws in the surface finish (eg. honeycombing, visible pieces of raw materials, air bubbles) may be exhibited in our products.

Our goods come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

What does the warranty NOT cover?

This warranty will not apply in respect of any damage or defect caused by, arising from or in any way attributable to any one or more of the following:

  • Item preference and/or change of mind;
  • Any defect that has not come from faulty materials or workmanship;
  • Any defect caused in transit or during delivery;
  • Improper installation of a product and/or installation not in accordance with our installation guide (including not allowing for expansion/contraction of the plastic) or failure to abide by any applicable laws or building codes;
  • Any products, fixing or part which has not been supplied or approved in writing by Plastic Forests being used with the product. No guarantee is provided for fixings (refer to the manufacturer of fixings’ warranty);
  • Any freight, installation or labour costs;
  • Any act of God (including but not limited to heavy rain, flooding, storm, wind, earthquake, lightning or hail);
  • Deterioration and/or damage to the external surfaces, discolouration, fading, spotting or staining from or caused, in whole or in part, by mould, mildew, other fungal growth, organic materials, metallic oxides or particles (including but not limited to rust or corrosion of any fasteners), dirt, normal weathering, other atmospheric or environmental pollutants, foreign substances such as grease, oil or chemicals (including, but not limited to those found in cleaners);
  • Damage resulting from fire or exposure to heat sources such as cooking devices or reflective surfaces;
  • Exposure to extreme temperatures for a period of time that causes the materials to wear/permanently deform, or bending/leaning of the product as a result of the sun or other factors;
  • The application of paints, stains, surface treatments (not approved by us in writing) or other chemical substances, including but not limited to cleaners or pesticides;
  • Splits or cracks in the vicinity of fasteners;
  • Small bubbles or blemishes on a product surface, or colour, fade or texture variation;
  • Climate change, environmental conditions or any related cause beyond our reasonable control;
  • Any modifications made by you to a product, whether before or after installation;
  • Improper handling, use, maintenance, storage, abuse or neglect of a product;
  • Failure of proper and timely maintenance or repair of a product;
  • Ordinary wear and tear or normal weathering; or
  • The impact from objects or damage caused by heavy loads.

This warranty also does not apply to the following types of products:

  • Products that have a defect where the defect was disclosed to you before purchase;
  • Any product where the defect was reasonably identifiable on physical examination of the product and you examined the product before purchase; and
  • Products that are re-sold by a re-seller that is not authorised by us, or to any second-hand purchases of product.

Exclusions

Except to the extent required by law, all consumer guarantees, representations, warranties, terms and conditions in relation to the products (whether implied or otherwise) are hereby excluded to the maximum extent permitted by law.

To the fullest extent permitted by law, Plastic Forests excludes all liability for damage or injury to any person, damage to any property, and any indirect consequential or other loss or damage.

Implied warranties

To the extent that any law (including the Competition and Consumer Act 2010(Cth)) (CCA) implies certain nonexcludable conditions, guarantees or warranties to the supply of goods or services by Plastic Forests to you, then, to the fullest extent permitted by law, Plastic Forests’ liability under or arising out of the supply of goods and services for breach of, or failure to comply with, any such conditions, guarantees or warranties shall be limited, at Plastic Forests’ option, to:

1) If the breach or liability relates to goods:

i) The replacement of the goods or the supply of equivalent goods;

ii) The repair of the goods;

iii) The payment of the cost of replacing the goods or of acquiring equivalent goods; or

iv) The payment of the cost of having the goods repaired;

2) If the breach or liability relates to services;

i) The supplying of the services again; or

ii) The payment of the cost of having the services supplied again.

Except to the extent that the law (including the CCA) provides that liability is not able to be excluded, and except as expressly specified in Plastic Forests’ warranty statement in this document, Plastic Forests shall not be under any liability to you in respect of any loss or damage (including any incidental, indirect, punitive, exemplary, or consequential damages or any loss of any of the following – profit, revenue, goodwill, bargain, anticipated savings, use of products or equipment, software, data or management time), however caused, which may be suffered or incurred or which may arise directly or indirectly in respect of any products and/ or any services supplied by Plastic Forests.

When does the warranty start?

The warranty starts on the date of purchase of the items and lasts until the Warranty Period expires.

Your Responsibilities

To make a claim under this warranty:

1) Cease using the product or isolate the affected product/area, at your own expense.

2) Send a brief written description and photo of the product, problem, or condition that you believe constitutes a defect, together with your name, contact address, email, phone number and your proof of purchase (your order number/ invoice and an original dated sales receipt) to Plastic Forests at sales@plasticforests.com.au

We reserve the right, in our sole discretion, to require photographs, further information or descriptions, or to physically inspect the products before accepting a particular claim under this warranty. Return of the faulty products is the purchasers’ responsibility, whether that be the financial cost of delivery or personal physical delivery of products to Plastic Forests. Please pack the product carefully as Plastic Forests shall have no liability whatsoever for any damage caused during or as a result of transit.

Once we receive your warranty claim, we may advise you as to temporary measures to take or repairs to make, at your own expense. If we request, you must allow us to enter the site on which the product has been installed to inspect the product and to undertake such repairs or take such other actions as we deem necessary or desirable (at our own expense).

You will be responsible for any costs associated with making a claim under this warranty unless otherwise agreed in writing by us. You must also bear the cost of any removal or disposal of defective products under this warranty.

Your failure to comply with the requirements in this section may result in us denying your claim or limiting your claim, at our absolute discretion. We will not be liable for any loss, damage or injury caused as a result of your failure to abide by this section.

Remedy under this warranty

If we determine that your claim is covered by the warranty, we will either, at our sole discretion:

a) repair or replace the defective product or portion of the product with a new product of ours that is the same or as similar as possible to the defective product; or

b) provide a refund of the relevant percentage of the original purchase price (ex GST) in accordance with the following table.

Any replacement of the product under this warranty will be as close in colour, design and quality to the original as reasonably possible, but an exact match is not guaranteed. Different fasteners may also be used. Plastic Forests will not be responsible for any freight, shipping or installation costs incurred. The warranty period does not restart, but rather continues from your original purchase date.
